Also -- there is zero chance a phone could get hot if there is no usage. The heat is the direct result of battery drain. Something is working. If you are experiencing heat right after setting up the phone, that is the phone syncing your data, etc. It is perfectly natural, just like after an upgrade, etc. Let the phone work for a few days.
Finally, a temperature in the 40C range is warm but not unusual. If the phone gets seriously hot there are built-in processes to reduce activity to cool it off or it will shut down entirely. You will see messages letting you know what's happening.
I am not trying to dismiss any concerns. But it seems there is a lot of worry over things that are normal and perhaps just not well-understood.
My advice is this:
- Use the phone for a few days -- don't judge it by the first 48 hours out of the box.
- Watch to see if the phone gives you any temperature warnings. If it doesn't, it is safe.
- Track your battery life. If you are getting through the day you probably don't have some crazy drain causing the heat.
- If it gets warm, consider what's running. If you are streaming media, gaming, navigating -- doing things that draw a lot of power -- then it is normal. If it gets warm without you doing anything, turn it off and back on again. That will kill any runaway processes that might be causing it to heat up.

The battery is in contact with everything else in a small package. Processors and radios can get to hot to touch - and the heat they generate can get transferred inside the case. Batterie generate heat when charging and discharging. So if you have a process that is using CPU or a weak signal that is boosting the radio - those components generate heat. They drain the battery faster which causes the battery to generate heat. It is a cycle that causes more heat.
